IN THE HIGH COURT OF ORISSA AT CUTTACK

BLAPL No. 8905 of 2022 Balakrishna Karada ....

Petitioner Mr. S. Mahunta, Advocate - Versus - State of Odisha ....

Opposite Party Mr. J. Tripathy, Addl. Standing Counsel

CORAM:

JUSTICE SASHIKANTA MISHRA

ORDER

02.12.2022 Order No.

1.

This matter is taken up through hybrid mode.

3.

2.

Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

3.

The petitioner had earlier approached this Court in BLAPL No. 59 of 2022, which was rejected granting him liberty to renew his prayer if trial is not concluded within a period of 8 months. 4.

It is submitted that trial has not yet commenced and in the meantime the petitioner has been in custody for nearly a year. 5.

Having regard to the huge quantity of contraband seized from the possession of the petitioner, I am not inclined to grant him regular bail. However, having regard to the fact that trial has not yet commenced, despite direction of this Court to expedite, I am inclined to take a lenient view in the matter. The bail application is disposed of directing the court below to release the petitioner on interim bail for a period of three months from the date of his actual release on such terms and conditions as it he may deem fit and proper to impose.

6.

BLAPL is accordingly disposed of.

7.

Issue urgent certified copy as per rules.
