Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in connection with C.T.(Spl) NDPS Case No.05 of 2022, pending before the learned Court of the Judge Special Court, Dhenkanal, arising out of P.S. Case No.345 dt.09.06.2022, for alleged commission of offences under Section 21(b) of the N.D.P.S. Act.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge, Dhenkanal, by order dated 30.08.2022 in the aforementioned case, the present BLAPL has been filed.

Admittedly since the quantity of the contraband (brown sugar) is to the tune of 15grams 200milligrams, which is less than the commercial quantity as prescribed and keeping in view that the petitioner is in custody since 10.06.2022 and filing of charge-sheet

on 07.08.2022, this Court directs the petitioner to be released on bail on such terms to be fixed by the Court in seisin over the matter. 5.

Learned counsel for the petitioner is not in a position to apprise this Court regarding the criminal antecedent of the petitioner. Learned Court in seisin is called upon to verify the same. If it comes to the fore that the petitioner has criminal antecedent of similar nature, this order shall stand recalled. 6.

Accordingly, the BLAPL stands disposed of.
