This matter is taken up through hybrid mode.

Heard Mr. H.N. Tripathy, learned counsel for the petitioner and Mr. S. Jena, learned Standing Counsel appearing for the School and Mass Education Department 3.

An additional affidavit has been filed by opposite party no.1 on 06.12.2021 incorporating the letter dated 01.12.2021 with regard to compliance of the order passed in W.P.(C) No. 28295 of 2021, wherein the Addl. Secretary to Govt., Department of School and Mass Education has directed the DSE, Odisha to the following effect:- "To The DSE, Odisha, Bhubaneswar Sub- W.P.(C) No. 28295 of 2021 filed by Gobinda Chandra Patra and another v. State of Odisha and others.

Sir, I am directed to invite a reference to your Letter No.27754 dated 22.10.2021 on the subject cited above and to request you to comply the order of Hon'ble O.A.T. passed in O.A. No. 3142 (C)/99 immediately under intimation to this Department.

This may be treated as mot urgent."

In view of the above, since communication has already

been made by the Government to the Director, Secondary Education, Odisha to comply the order passed by the tribunal in O.A. No. 3142 (C)/99, opposite party no.2 is directed to comply the same, as expeditiously as possible, preferably within a period of six weeks from the date of production of certified copy of this order.

The writ petition is accordingly disposed of. Issue urgent certified copy as per rules.
