Petitioner has filed this writ petition assailing forceful seizure of his Truck bearing Registration No.OD-05-AK-5047 due to non-payment of the defaulted amount by Opposite Party Nos.3 and 4.

In course of hearing, Mr. Samantaray, learned counsel for the Petitioner, on instruction, submits that the vehicle has already been auctioned in the meantime. Hence, he prays for withdrawal of the writ petition seeking liberty to file a fresh one with better particulars challenging the auction held in respect of the aforesaid vehicle in the meantime.

Granting such liberty, this writ petition is disposed of as withdrawn.
