This matter is taken up through Hybrid Mode.

Heard Mr.A.K.Panigrahi, learned counsel for Petitioner and Mr. A.P.Das, learned Addl. Standing Counsel for the StateOpposite Parties. 3.

Learned counsel for the Petitioner submitted that even though an appeal has been filed under Annexure-1 with a prayer to waive out the heavy punishment imposed against the Petitioner, but the Opposite Party No.1 is neither taking up the same and thereby causing prejudiced to the Petitioner. 4.

Since an appeal has been filed since 17.09.2018, this Court directs the Opposite Party No.1 to consider and dispose of the said appeal in accordance with law, if it has not yet been disposed of in the meantime within a period of one month from the date of receipt of this order. The order so passed by the Opposite Party No.1 shall also be communicated to the Petitioner within that time.
