Heard learned counsel for the petitioner, learned counsel for the State and learned counsel for the informant. 3.

Learned counsel Mr. A. Pradhan has filed Vakalatnama on behalf of Opposite Party No.2. The same is taken on record. 4.

The petitioner is an accused in connection with Spl. G.R. Case No.95 of 2022, pending in the Court of learned Additional Sessions Judge-cum-Special Court under POCSO Act, Cuttack, arising out of Madhupatna P.S. Case No.174 of 2022, for offences under Sections 363/366/376(2)(n) of IPC read with Section 6 of POCSO Act.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge-cumSpecial Court under POCSO Act, Cuttack, by order dated 26.08.2022 in the aforementioned case, the present BLAPL has been filed.

The Opposite Party No.2-informant who is the father of the victim, has filed an affidavit inter alia stating that the matter has been amicably settled and the victim has decided to join the accused in matrimony after attaining majority.

Taking note of such submission, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
