This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in connection with C.T. Case No.1947 of 2022, pending in the file of the learned S.D.J.M., Jharsuguda, arising out of Jharsuguda P.S. Case No.429 of 2022, for offences under Section 379 of IPC.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge, Jharsuguda, by order dated 25.08.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the order of rejection.

Taking into account the nature of allegations and the punishment prescribed and since the petitioner is in custody from 28.07.2022 and as there has been substantial progress in investigation as stated by the learned counsel for the petitioner, this
Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter. 7.
Taking note of the submission of the learned counsel for the State, keeping in view of the antecedents of the petitioner, as evidenced from the order of rejection, this Court directs the petitioner to appear before the local police station once every week till conclusion of investigation.

Accordingly, the BLAPL stands disposed of.
