Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 23.09.2019 in connection with Gurundia P.S. Case No.29 of 2019 corresponding to G.R. Case No.442 of 2019 pending in the Court of learned S.D.J.M., Bonai for the alleged commission of offence under Sections 25(1-B)(a) of Arms Act.

It is alleged that the petitioner and another person committed murder of the deceased by assaulting him by means of an axe on his neck. The only basis of implication of the petitioner appears to be the statement of co-accused, Arjun Oram. There is no other material to show his complicity in the alleged occurrence. 5.

Considering the above facts as also taking into the period of detention of the petitioner in custody, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally appear before the trial Court on each date of posting of the case

without fail.

BLAPL is accordingly disposed of.
