Petitioners Mr. P.K. Mishra, Advocate -versusState of Odisha ....

CORAM:

MR. JUSTICE D.DASH

ORDER

30.09.2022 I.A. NO. 1757 OF 2022 Order No.

07.

1.

This matter is taken up through hybrid arrangement (virtual/physical) mode.

2.

This is an application for modification of order dated 19.09.2022 passed in ABLAPL No.12865 of 2020. 3.

Learned Counsel for the Petitioners placing the handwriting expert's report submits that although it has been reported that the forgery has been detected yet there is definite opinion therein that these Petitioners had no role and as such had not done so. He, therefore, submits for passing appropriate order of modification.

4.

Learned Counsel for the State submits that if that is so, the Petitioner can very well so contend before the Court below while moving for grant of regular bail.

5.

Taking into account the submission made; this application stands disposed of with the observation that the Petitioners in obedience to the earlier order dated 19.09.2022 if surrender and move for grant of bail, the Courts below would do well to consider the above contention of the Petitioners and its impact as per law in that matter of grant of bail.

// 2 // 6.

In the above premises, the time period for surrender of the Petitioners is hereby extended for three weeks more with effect from today.

7.

The I.A. is accordingly disposed of.

Issue urgent certified copy as per rules.

(D. Dash), Judge.
