This matter is taken up through Hybrid arrangement (video conferencing/physical mode). This is an application for modification of the order dated 18.02.2022.
While granting bail to the petitioner, this Court, inter alia, imposed a condition that the petitioner shall appear before the Inspector incharge of Chauliaganj police station on each Sunday in between 10.00 a.m. to 4.00 p.m. till the conclusion of trial.
Learned counsel for the petitioner submitted that the petitioner is a man of Village-Badadwdhilo under Jagatsinghpur police station in the district of
// 2 // Jagatsinghpur. He further submitted that after being released on bail, the petitioner is complying with the aforesaid condition and appearing before the Inspector in-charge of Chauliaganj police station on each Sunday in between 10.00 a.m. to 4.00 p.m. and documents to that effect have been annexed to the interim application.
It is further submitted that the petitioner is facing difficulty in attending the Chauliaganj police station on every week and therefore, the order dated 18.02.2022 may be modified to the extent that the petitioner shall appear before the Jagatsinghpur police station instead of Chauliaganj police station on each Sunday in between 10.00 a.m. to 4.00 p.m. till conclusion of the trial. Learned counsel for the State has no serious objection.
Considering the submissions made by the learned counsel for the respective parties, the documents annexed to the interim application, I am inclined to modify the order dated 18.02.2022 and direct that the petitioner instead of appearing before the Chauliaganj police station on each Sunday, shall appear before the Jagatsinghpur police station on each Sunday in between 10.00 a.m. to 4.00 p.m. till conclusion of the trial. The rest part of the order
// 3 // dated 18.02.2022 shall remain unaltered.
Accordingly, the I.A. is disposed of.
