This matter is taken up through hybrid mode.

Heard learned counsel for the Petitioner and the learned counsel for the State.

The Petitioner is an accused in connection with T.R Case No.36 of 2022, pending on the file of the learned Special Court under POCSO Act, Jeypore, arising out of Koraput Sadar P.S. Case No.51 of 2022 for commission of the alleged offence under Sections 366/506/376(2)(n) IPC and Section 6 of the POCSO Act and Section 66E of the I.I Act 4.
Being aggrieved by the rejection of his application for bail U/s. 439 Cr.P.C. by the learned Special Court under POCSO Act, Jeypore by order dated 11.08.2022, the present BLAPL has been filed.

Perused the statement of the victim recorded under Section 164 Cr.P.C.

Taking into account that the Petitioner is in custody since 05.04.2022 and filing of the charge sheet on 03.06.2022, this Court directs the Petitioner to be released on bail on such terms to be fixed by the learned court in seisin over the matter. 7.
Accordingly, the BLAPL stands disposed of.
