This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in connection with T.R. Case No.72 of 2022, pending in the Court of learned Additional Sessions Judge-cum-Special Judge, Gunupur, arising out of Chandrapur P.S. Case No.57 of 2022, for offences under Section 20(b)(ii)(B) of NDPS Act.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge-cumSpecial Judge, Gunupur, by order dated 07.09.2022 in the aforementioned case, the present BLAPL has been filed. 5.
Perused the order of rejection.

Considering the quantity of contraband seized to the tune of 7Kg. 150 grams of contraband (Ganja), which is admittedly less than the commercial quantity and the period of custody, this Court
directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter. 7.
Additionally, it is directed that he shall appear before the jurisdictional police station once every month till conclusion of trial.
8.
Violation of such appearance shall entail cancellation of bail.
9.
Accordingly, the BLAPL stands disposed of.
