1. Learned counsel appearing for the Petitioner seeks leave to withdraw the present petition with liberty to challenge the impugned order of the Excise Commissioner before the Secretary, Excise Department, Government of Odisha under Section 6 of the Odisha Excise Act.

2. If such revision petition is filed not later than 2nd January, 2023 accompanied by an application for condonation of delay explaining the delay on account of the pendency of the present petition, it will be considered in accordance with law by the revisional Authority. The Court clarifies that it has not expressed any view in the matter.

3. Accordingly, the writ petition is disposed of as withdrawn with liberty as prayed for in the above terms.
