Heard Mr. S. Satapathy, learned counsel for the petitioners and Mr.

S.S.

Pradhan, learned Additional Government Advocate.

On oral prayer, Mr. Satapathy is permitted to correct the description of the petitioners in the cause title in Court today. 3.

Office note indicates that the vakalatnama has not been executed by the petitioner No.5. In such background, Mr. Satapathy prays that the present writ petition be confined to petitioner Nos.1 to 4, 6 & 7 only. Prayer is allowed. 4.

Mr. Satapathy submits that the petitioners are the legal heirs of one Bhagirathi Khuntia, who is the recorded tenant as indicated under Annexure-4, whose land was acquired for the purpose of construction of Baitarani Left Bank Canal, Anandapur Canal Division, Salapada under Anandapur Barrage Project. However, till date the compensation has not been paid on account of such acquisition.

During course of hearing, Mr. Satapathy submits that

// 2 // liberty may be granted to the petitioners to move the Special Land Acquisition Officer, Anandapur Barrage Project, Salapada (opposite party No.2) in the matter by filing a grievance petition and the said opposite party be directed to take a decision on such motion within a specific time period.

Considering the submissions made and without expressing any opinion on the merits of the case, this Court grants liberty to the petitioner to file a grievance petition before the Special Land Acquisition Officer, Anandapur Barrage Project, Salapada (opposite party No.2) through registered post within a period of two weeks from today. In the event, such a petition is filed along with a copy of this order, the opposite party No.2 is directed to take a decision on the same in accordance with law within a period of eight weeks from the date of receipt of such grievance petition and communicate the result of such exercise to the petitioner No.2, who in turn is directed to share such information with petitioner Nos.1, 3, 4, 6 & 7.

Accordingly, this writ petition is disposed of. 8.

Urgent certified copy of this order be granted on proper application.
