Heard Mr. A.K. Panda, learned counsel appearing for the petitioner, Mr. P.K. Parhi, learned DSGI and Mr. R.C. Mohanty, learned counsel appearing for the opposite party no.4. 3.

Mr. A.K. Panda, learned counsel appearing for the petitioner contended that in view of the judgment of the Apex Court in the case of Pharmacy Council of India v. Rajeev College of Pharmacy, 2022 LiveLaw 768, the relief sought by the petitioner is no more remains to be considered by this Court and as such the petitioner does not want to press this writ petition seeking permission to apply afresh in terms of the new rule applicable to the institution. Learned counsel for the petitioner also files a memo to that effect, which may be kept on record. 4.

Learned counsel appearing for the opposite parties have no objection to the above submission of learned counsel for the petitioner.

In view of the above, the writ petition stands disposed of permitting the petitioner to file fresh application in terms of the new rule applicable to the institution, if he is so advised. 6.
