W.P (C) No.23829 of 2022 M/s. On Net Solutions, Bargarh .....

State of Odisha and others .....
Opposite Parties Mr. P.P. Mohanty, AGA
CORAM:
DR. JUSTICE B.R. SARANGI MR. JUSTICE G. SATAPATHY
ORDER
10.10.2022 Order No.
This matter is taken up through hybrid mode.
2.
Heard Mr. S.R. Mahapatra, learned counsel for the petitioner and Mr. P.P. Mohanty, learned Additional Government Advocate appearing for the State-opposite parties. 3.
The petitioner has filed this writ petition seeking direction to the opposite parties to consider the pre-bid queries raised by the petitioner in its letters dated 3rd August 2022 and e-mails dated 25th August 2022 and 3rd September 2022 on the Tender Call Notice before submissions of bid documents and in alternative to quash the Tender Call Notice dated 25th July, 2022 and the subsequent corrigendum in relation to the tender call notice. 4.
Mr. S.R. Mahapatra, learned counsel for the petitioner urged before this Court that as per tender call notice pre-bid meeting was to be held and, as such, the petitioner raised certain queries, which have been placed at page-86 to 86B of the writ petition. It is contended that though the petitioner raised certain queries, but the opposite parties have not responded to the same
till date. Therefore, the petitioner could not be able to proceed further.
5.
Mr. P.P. Mohanty, learned Additional Government Advocate appearing for the State-opposite parties contended that since the petitioner has made certain queries, direction may be issued to the tendering authority to take care of the issue, which has been raised in this writ petition.
6.
Considering the contentions raised by learned counsel for the parties and after going through the records, this Court, at the outset, is not inclined to issue notice to opposite parties no.2 & 4, because of the prayer made in the writ petition. Since limited question is involved that the pre-bid queries raised by the petitioner has not been answered, this Court disposes of the writ petition directing opposite party no.2 to take into consideration the pre-bid queries and communicate the result thereof to the petitioner as expeditiously as possible, preferably within a period of 15 days from the date of communication/production of certified copy of this order.
7.
Issue urgent certified copy as per rules.
