This matter is taken up through video conferencing mode. 2.

On oral prayer, learned counsel for the petitioner is permitted to implead the Deputy Director (Revenue), Employees State Insurance Corporation as opposite party No.3 in the writ petition.

Heard Mr. S. Mishra, learned counsel for the petitioner and Mr.

A.P.Ray, learned counsel representing E.S.I.

Corporation.

Mr. Mishra submits that though the petitioner has filed this writ petition with a prayer for refund certain amount which has been recovered from its account by means of a Garnishee order however, during course of hearing, he submits that liberty may be granted to the petitioner to approach the opposite party No.3 for redressal of its grievances and further prays that the said opposite party be directed to take a decision on such grievance petition within a specific time period. 5.

Considering the submissions made and without

// 2 // expressing any opinion on the merits of the case, this Court grants liberty to the petitioner to file a grievance petition before the opposite party No.3 within a period of two weeks from today. In the event, such a petition is filed along with a certified copy of this order, the opposite party No.3 is directed to take a decision on the same in accordance with law within a period of eight weeks from the date of receipt of such grievance petition after giving opportunity of hearing to the petitioner and communicate the result of such exercise to the petitioner. 6.

Accordingly, this writ petition is disposed of. 7.

Urgent certified copy of this order be granted on proper application.
