This matter is taken up through hybrid mode.

Heard learned counsel for the Petitioner and learned counsel for the State.

The Petitioner is an accused in 2(a)CC Case No.728 of 2022 pending in the file of learned J.M.F.C., (Rural), Cuttack, arising out of Cuttack Excise (EI & EB UNH-1) P.R Case No.250 of 2022-23, offence under Section 52(a)(i) of the Odisha Excise Act and is in custody since 02.09.2022.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned 1st Additional Sessions Judge, Cuttack by order dated 13.09.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the order of rejection.

Taking note of the nature of allegation and the punishment prescribed, this Court directs the Petitioner to be released on bail on

such terms to be fixed by the learned court in seisin over the matter. Additionally it is directed that the Petitioner shall appear before the excise officials once every week till the submission of final P.R. 7.

Accordingly, the BLAPL stands disposed of.
