This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in T.R. Case No.03 of 2020, on the files of learned Sessions Judge-cum-Special Judge, Koraput, arising out of Boriguma P.S. Case No.02 of 2020, under Sections 20(b)(ii)(c)/25/29 of the NDPS Act and is in custody since 07.01.2020.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Court of Sessions Judge, Koraput, Jeypore, by order dated 21.01.2020 in the aforementioned case, the present BLAPL has been filed. 5.
Taking into account the nature of allegations and the contraband seized this Court is not inclined to exercise the discretion under Section 439 of the Cr.P.C.

Accordingly, the BLAPL stands rejected. Since the petitioner is stated to be in custody since 07.01.2020, the learned Court in seisin of the matter shall expedite the trial. (V. NARASINGH) Judge Santoshi
