This matter is taken up through hybrid mode.

Heard learned counsel for the Petitioner and learned counsel for the State.

The Petitioner is an accused in C.T Case No.257 of 2022 pending in the file of learned J.M.F.C., Soro, arising out of Simulia P.S. Case No.89 of 2022, for offence under Sections 498A/306/294/507/506/34 IPC and is in custody since 01.05.2022. 4.
Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned 2nd Addl. Sessions Judge, Balasore by order dated 05.09.2022 in the aforementioned case, the present BLAPL has been filed.

It is submitted by the learned counsel for the Petitioner that the Petitioner was forwarded inter alia under Section 302 IPC. After investigation, charge sheet has been filed under Section 306 IPC and other allied sections.

Considering such submission and filing of the charge sheet on 27.08.2022 and as the Petitioner is in custody since 01.05.2022, this Court directs the Petitioner to be released on bail on such terms to be fixed by the learned court in seisin over the matter. 7.
Accordingly, the BLAPL stands disposed of.
