This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in C.T. Case No.621 of 2022, pending in the file of learned J.M.F.C., Betnoti, arising out of Betnoti P.S. Case No.226 of 2022, for alleged commission of offence under Sections 420 of IPC.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge-cumSpecial Judge (Vigilance), Baripada by order dated 08.09.2022 in the aforementioned case, the present BLAPL has been filed. 5.

Taking into account the nature of allegations and that the petitioner is in custody since 27.07.2022 and filing of charge sheet on 08.09.2022, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

While releasing the petitioner on bail learned Court in seisin shall verify assertion regarding criminal antecedent of the petitioner. If it comes to the fore that the petitioner has criminal antecedent of any nature this order shall stand recalled. 7.

Accordingly, the BLAPL stands disposed of.
