1.This matter is taken up through hybrid mode.

2. Heard.

3. Learned counsel for the petitioner submits that the petitioner has been serving as a Senior Stenographer in the officer of the Medical Superintendent, S.C.B. Medical College and Hospital, Cuttack. He further submits that the Petitioner was placed under suspension with effect from 05.12.2019 and reinstated in service on 23.07.2020. It is also submitted that the petitioner is entitled to get the annual increment with effect from 05.12.2019 as per Rule77 of the Odisha Service Code unless it is withheld by the authority. But, in the present case, there is no order of withholding of increment of the Petitioner. However, without any order, the petitioner is deprived of to get the

// 2 // annual increment because of pendency of disciplinary proceeding against him.

4. Learned counsel for the Petitioner further submits in letter dated 22.09.2022 the grievance of the petitioner raised in this Writ Petition has already been redressed and the petitioner has already got the annual increment.

5. Accordingly, this Writ Petition is disposed as infructuous.
