Heard learned counsel for the petitioner and learned counsel for the State.

It is submitted that the petitioner was granted bail in ABLAPL No.16128 of 2019 and it was worked out but then charge sheet was submitted showing him as an absconder consequent upon which the learned S.D.J.M., Paralakhemundi issued NBWA which is pending execution.

Considering the above and taking into account the fact that the petitioner was on bail but thereafter coercive action was taken by the learned court below, the petitioner should be allowed to surrender and go on bail subject to conditions. 4.

Accordingly, it is ordered.

In the result, the CRLMC stands disposed of with a direction to the petitioner to surrender before the learned S.D.J.M.,Parlakhemundi on or before 20th October, 2022 in connection with G.R. Case No.312 of 2019 and in the event of his surrender within the stipulated time, the court shall release him on bail subject to conditions.

An urgent certified copy of this order be granted as per rules.
