This matter is taken up through hybrid mode.

Heard learned counsel for the Petitioner and learned counsel for the State.

The Petitioner is an accused in 2(a)CC Case No.101 of 2022 pending in the file of learned J.M.F.C., Borigumma, arising out of Borigumma Excise P.R. Case No.77 of 2022, offence under Section 52(a) of the Odisha Excise Act and is in custody since 18.08.2022.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge, Jeypore by order dated 12.09.2022 in the aforementioned case, the present BLAPL has been filed.

Taking note of the nature of allegation and the punishment prescribed, this Court directs the Petitioner to be released on bail on such terms to be fixed by the learned court in seisin over the matter.

Additionally it is directed that the Petitioner shall appear before the excise officials once every week till the submission of final P.R. 6.

Accordingly, the BLAPL stands disposed of.
