This matter is taken up through hybrid mode.

This RPFAM has been filed assailing the order dated 9th August, 2022 (Annexure-2) passed by learned Judge, Family Court, Dhenkanal in Cr.P. No.102 of 2021, whereby refusing the prayer of Petitioner No.1 for grant of maintenance, he directed the Opposite Party to pay Rs.15,000/- per month to the Petitioner No.2 (Son).

In course of hearing, Mr. Mohanty, learned counsel for the Petitioner submits that in the meantime, the proceeding for dissolution of marriage filed by the Opposite Party in C.P. No.111 of 2021 has been dismissed by learned Judge, Family Court, Dhenkanal on 2nd September, 2022. In view of the change in circumstance, Mr. Mohanty, learned counsel for the Petitioner prays for withdrawal of the RPFAM to move appropriate application before learned Judge, Family Court for variance of the order and/or of maintenance under Section 125 Cr.P.C.
