Heard learned counsel for the Parties.

Learned counsel for the Petitioner is unable to show through materials that the mutation case has a link to Annexure-3. Though the mutation proceeding at Page-18 clearly discloses that Petitioner has a claim over the Plot No.1635 and 1637, whereas Annexure-3 appears to be a notice involving Plot No.1636. This Court nowhere finds any link to the mutation case, however for the notice at Annexure-3, it is unable to accede to the prayer of the Petitioner to undertake construction till the mutation case on remand is over. However, considering the request for expeditious disposal of the remand mutation proceeding, this Court observes, in the event the remand mutation case involved herein is still pending, following the direction of the appellate authority there should be showing of finality to such proceeding by the Tahasildar, JajpurOpposite Party No.4. 3.

In the process in disposal of the Writ Petition, this Court directs Opposite Party No.4 to show finality to the Mutation Case No.32 of 1994 at least by completing the same proceeding within a period of two

Petitioner may appear before the Tahasildar, Jajpur-Opposite Party No.4 along with a certified copy of this order on 10th October, 2022 and take the date of next hearing of the matter. (Biswanath Rath) Judge Swarna
