This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

Considering the recitals in the I.A. and taking into account the submissions of the learned counsel for the petitioner, this Court is not inclined to entertain this I.A for interim bail of the petitioner on the ground of illness of his father.

Accordingly, the I.A. stands dismissed.

The petitioner is an accused in T.R. Case No.42/84 of 2021, pending in the file of learned Additional Sessions Judge-cumSpecial Judge, Nayagarh, arising out of Ranpur P.S. Case No.55 of
2021, for commission of alleged offences under Sections 20(b)(ii)C of NDPS Act.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge, Nayagarh by order dated 09.09.2022 in the aforementioned case, the present BLAPL has been filed.

Since the trial has already commenced and ten witnesses have already been examined, this Court is not inclined to entertain this bail application at this stage.

The learned Court in seisin is called upon to conclude the trial within the period of four month from the receipt/production of copy of this order. In the event trial is not concluded within the time stipulated, it shall be open to the petitioner to renew his prayer. 5.
In the interregnum, liberty is granted to the petitioner to approach the learned Court in seisin for interim release on account of health of his father.

Registry is requested to communicate with this order. 7.
Accordingly, the BLAPL stands disposed of.
