This matter is taken up through Hybrid Mode.

Order No 2.

Heard learned counsel for Petitioner and learned counsel for the State-Opposite Parties.

The present Writ Petition has been filed with the following prayer:- "(i) It is, therefore, prayed that your Lordship's be graciously pleased to admit the writ petition, issue rule nisi in the nature of appropriate writ or any other writ(s) as deem fit and proper calling upon the Opp. Parties to show cause as to why the prayer made hereunder shall not be allowed, and if no/insufficient cause is shown, the said rule be made absolute by issuing writ(s) in the nature of;

The Opp. Parties be directed for modification of the Grade Pay to Rs.5400/- instead of Rs.4800/- on completion of 20 years of continuous service at the stage of 2nd financial up-gradation under Revised Assured Career Progress Scheme (RACPS) in accordance with the Odisha Revised Scale of Pay (ORSP) Rules, 2008 with all other consequential service and financial benefits taking into consideration at Annexure-5 at an early date in the interest of justice".

Learned counsel for the Petitioner submits that through highlighting his grievances, the Petitioner has filed a representation at Annexure-6 to the Writ Petition, before the opposite party No.2 but till date nothing has been done in the matter. In such background, he prays that a direction be issued to opposite party No.2 to take a decision on the above noted petition within a specific time period. 5.

Considering the submissions made and without expressing any opinion on the merits of the case, this Court directs opposite party No.2 to take a decision on the above noted petition in accordance with law and also taking into account the order passed under Annexure-5 within a period of three months from the date of production of certified copy of this order and communicate the result of such exercise to the petitioner.

6. With the aforesaid observation and direction, the Writ Petition is disposed of.
