This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).

Heard learned counsel for the parties.

This is an application under Section 439 of the Code of Criminal Procedure filed by the Petitioner for bail in connection with Mohana P.S.Case No.120 of 2020, corresponding to G.R.Case No.35 of 2020, pending in the Court of the learned Special Judge-cumSessions Judge, Gajapati, Parlakhemundi. for alleged commission of offence under Sections 20(b)(ii) C/25/29 of the N.D.P.S.Act. 4.

Learned Counsel for the Petitioner does not want to press this application at this juncture. However he seeks liberty of this Court to move a fresh bail application, in the event the trial is not concluded within a time stipulated by this Court.

Considering such submissions, this Court disposes of the bail application as not pressed. However, learned trial Court is directed to expedite the trial and conclude the same as expeditiously as possible

// 2 // preferably within a period of four months. In the event the trial is not concluded, within the aforesaid period, it is open for the Petitioner to move a fresh bail application and in the event such application for bail is filed, the same shall be considered in accordance with law without being influenced by any other factor. 6.

Issue urgent certified copy as per Rules.
