Heard Mr. Arjuna Charana Behera, learned counsel for the petitioner and Mr. D.K. Mohanty, learned Additional Standing Counsel for the State.

According to Mr. Behera, the petitioner is aggrieved by non-payment of compensation though his land i.e. Plot No.269 pertaining to Holding No.223/33 covering an area of Ac.0.71 dec. falling under Mouza-Gandamer in the District of Nuapada has been forcibly submerged due to renovation work done by the B.D.O., Komna in Kitchikitchi Munda Pond at Gandamer. 3.

During course of hearing, Mr. Behera submits that liberty may be granted to the petitioner to move the Collector and District Magistrate, Nuapada (opposite party No.3) by filing a representation for redressal of his grievances and the said opposite party be directed to take a decision on such motion within a specific time period.

Considering the submissions made and without expressing any opinion on the merits of the case, this Court grants liberty to the petitioner to file a comprehensive representation before the Collector and District Magistrate, Nuapada (opposite party No.3) through Registered Post within a period of two weeks from today. In the event, such a representation is filed along with a copy of this order, the opposite party No.3 is directed to take a decision on the same in accordance with law within a period of eight weeks from the date of receipt of such representation and communicate the result of such exercise to the petitioner.

Accordingly, the writ petition is disposed of. 6.

Urgent certified copy of this order be granted on proper application.
