This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in connection with G.R. Case No.1708 of 2022, pending in the Court of learned S.D.J.M., Talcher, arising out of Talcher P.S. Case No.535 of 2022, for offences under Section 392 of IPC.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge, Talcher, by order dated 13.09.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the order of rejection.

It is submitted by the learned counsel for the petitioner that the petitioner has been remanded in the case at hand because of his criminal proclivity. It is further submitted by the learned counsel for the petitioner that the petitioner was not identified in the T.I. Parade. Hence, he seeks release on bail.

Taking into account the submission of the learned counsel for the petitioner, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Keeping in view the criminal proclivity of the petitioner, it is directed that the petitioner shall appear before the Investigating Officer once every week till conclusion of trial. 9.
Accordingly, the BLAPL stands disposed of.
