02. 1. This matter is taken up through virtual mode.
2. The present contempt petition has been filed with the allegation that the order dated 7.2.2019 passed in W.P.(C) No.5371 of 2019 has not been complied with.
3. Upon perusal, we find that the direction is to promote the petitioner to continue in service as Homoeopathy Medical Officer on the parity of direction with identically situated persons.
4. It is apparent from the cause-title that the petitioner is aged about 74 years in the year 2019 itself and hence it is not understandable as to how he be permitted to continue in service.

5. On pointed query, even the counsel for the petitioner is unable to dispute the factual position.
6. In view of the above, we find no reason to pursue the contempt petition.
Accordingly the contempt proceeding is dropped.
7. As the restrictions due to resurgence of COVID-19 situation are continuing, learned counsel for the parties may utilize a printout of the order available in the High Court's website, at par with certified copy, subject to attestation by the concerned advocate, in the manner prescribed vide Court's Notice No.4587, dated 25th March, 2020, modified by Notice No.4798, dated 15th April, 2021, and Court's Office Order circulated vide Memo No.514 and 515 dated 7th January, 2022.
