This matter is taken up through hybrid mode.

Heard learned counsel for the Petitioners and learned counsel for the State.

The Petitioners are accused in 2(a) CC Case No.69 of 2022 pending in the file of learned J.M.F.C., Dasapalla, for offence under Section 52(a) of the Odisha Excise Act and is in custody since 04.09.2022.

Being aggrieved by the rejection of their application for bail U/s.439 Cr.P.C. by the learned Addl. Sessions Jude, Nayagarh by order dated 14.09.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the order of rejection.

Taking into account the period of custody, nature of allegation and the punishment prescribed, this Court directs the
Petitioners to be released on bail on such terms to be fixed by the learned court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
