This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in C.T. Case No.175 of 2022, pending in the file of learned JMFC, Jashipur, arising out of Jashipur P.S. Case No.186 of 2022, for commission of alleged offences under Sections 307/323/325/341/34 of IPC. 4.
Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge, Karanjia by order dated 08.09.2022 in the aforementioned case, the present BLAPL has been filed.

It is submitted by the learned counsel for the petitioner that the petitioner is in custody since 27.07.2022 and as the investigation has progressed substantially, further continuance of the petitioner in custody is not warranted.

It is also further submitted that in the meanwhile the victim has been discharged and is leading a normal life.

On instructions, learned counsel for the State apprises the Court that the condition of the victim is stable. 8.
Taking into account the submission of the learned counsel for the petitioner, on instructions, that petitioner is the first offender and the health condition of the victim is stable, as stated by the learned counsel for the State, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Additionally it is directed that the petitioner shall appear before the I.O. once every week till submission of final form. 10.
While enlarging the petitioner on bail, the learned court below shall verify assertion regarding his criminal proclivity. If it comes to the fore that the petitioner has criminal antecedent of any nature, this order shall stand recalled without further reference to this Court.

Accordingly, the BLAPL stands disposed of.
