2. This application has been filed by the petitioner-wife under Section 24 of C.P.C. for transfer of C.S. No.(MAT) 89 of 2018 filed by the opp. party-husband under Section-9 of the Hindu Marriage Act for restitution of conjugal Right in the Court of learned Civil Judge (Senior Division), Koraput, to the Court of learned Judge, Family Court, Berhampur, Ganjam.

Notice has been issued to opp. party through Court process vide order dated 17.05.2022, pursuant to which, Mr. Santosh Kumar Mahanty, learned counsel appears today and files Vakalatnama on behalf of the opp. party. He also files a memo alongwith the attested copy of the judgment dated 4.5.2022 passed in C.S. (MAT) No.89 of 2018, perusal of which indicates that the suit has been decreed ex parte against the respondent.
