Heard learned counsel for Petitioner and learned counsel for the Union of India.

The present Writ Petition has been filed with the following prayer:- " The petitioner therefore prays that your Lordships would be graciously pleased to admit the Writ Petition, call for the records from the Opp. Parties and after hearing the parties allow the same with cost throughout and issue Writ/Writs in the nature of certiorari / mandamus and / or any other or further writ/directions quashing the letter dated 02.04.2019 under Annexure-4, letter dated 06.09.2019, dtd.
13.10.2020 and dtd.22.01.2021 under Annexure-5-Series and letter dated 18.02.2021 under Annexure-7 and direct the Opp. Party No.2 to waive out the penal interest @ 8.5.% for recovery of excess E.P.F Pension which is received by the Petitioner inadvertently".

Learned counsel for the Petitioner submits that through highlighting his grievances, the Petitioner has filed a representation at Annexure-9 to the Writ Petition, before
// 2 // the opposite party No.3 but till date nothing has been done in the matter. In such background, he prays that a direction be issued to opposite party No.3 to take a decision on the above noted petition within a specific time period. 5.
Considering the submissions made and without expressing any opinion on the merits of the case, this Court directs opposite party No.3 to take a decision on the above noted petition in accordance with law within a period of three months from the date of production of certified copy of this order and communicate the result of such exercise to the petitioner.

With the aforesaid observation and direction, the Writ Petition is disposed of.
