1. This matter is taken up through Hybrid Arrangement Order No (Virtual/Physical) Mode.
2. Heard Mr. H.K. Mohanta, learned counsel for the Petitioner and Mr. R. Behera, learned counsel appearing for the Opp. Party.
3. This transfer petition has been filed seeking transfer of MAT Case No. 31 of 2022 pending in the file of learned Senior Civil Judge, Udala to the Court of learned Judge, Family Court at Baripada.
4. Mr. Mohanta, learned counsel for the Petitioner submitted that the Petitioner after being deserted by her husband is residing with her parents under Baisinga P.S. in the district of Mayurbhanj and there is threat to her life at Udala, which will be more than 50 K.M. from her place of residence. It is also contended that there is difficulty in availing the communication to attend the Court at Udala.
5. Considering the grounds taken in the transfer petition and the decisions governing the field I am inclined to allow the prayer as
// 2 // made in the transfer petition. Accordingly, this Court directs Senior Civil Judge, Udala to transfer MAT Case No. 31 of 2022 to the Court of learned Judge, Family Court at Baripada forthwith on receipt of this order.
