This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in connection with G.R. Case No.329 of 2022, pending in the file of learned J.M.F.C., Purushottampur, arising out of Purushottampur P.S. Case No.351 of 2022, for offences under Sections 272/273/34 of IPC read with Section 52(a) of Odisha Excise Act.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional District & Sessions Judge, Chatrapur, Ganjam, by order dated 07.09.2022 in the aforementioned case, the present BLAPL has been filed. 5.

It is submitted by the learned counsel for the petitioner that because of his criminal proclivity, the petitioner has been remanded in the case at hand.

Taking into account the nature of allegations and the punishment prescribed, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Additionally it is directed that the petitioner shall appear before the Investigating Officer once every week till the submission of final P.R.

8.

Accordingly, the BLAPL stands disposed of.
