IN THE HIGH COURT OF ORISSA AT CUTTACK

BLAPL No. 9117 of 2022 Harihar Sarangi ....

Petitioner Mr. R.K.Pattanaik, Adv.

- Versus - State of Odisha ....

Opp.Parties Mr. M. Mishra, Addl. Standing Counsel

CORAM:

JUSTICE SASHIKANTA MISHRA

ORDER

29.09.2022 1.

This matter is taken up through hybrid mode.

Order No.

01.

2.

Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

3.

The petitioner is in custody in connection with Jagatsinghpur P.S. Case No.478 of 2021 corresponding to C.T. Case No. 119 of 2022 pending in the Court of learned Addl. Sessions Judge, Jagatsinghpur for the alleged commission of offence under Sections 498-A/ 304-B/306/506/34 of IPC read with Section 4 of D.P. Act.

4.

Petitioner's earlier bail application was rejected by this Court as per order passed in BLAPL No. 11199 of 2021 granting liberty to the petitioner to renew his prayer for bail after examination of the informant during trial. The informant has in the meantime been examined, who has entirely supported the prosecution story. 5.

It is submitted by Mr. Pattnaik that the petitioner may be released on interim bail in order to take care of his family members, who are in difficulty because of his long period of incarceration.

6.

Considering the submissions as above, while not being inclined to grant regular bail to the petitioner, the bail application is disposed of directing the learned court below to release the petitioner on interim bail for a period of six weeks from the date of his actual release on such terms and conditions as he may deem fit and proper to impose.

7.

BLAPL is accordingly disposed of.

8.

Issue urgent certified copy as per rules.
