This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in connection with Spl. G.R. Case No.21 of 2022, pending in the Court of learned Additional District Judge-cum-Special Court under POCSO Act, Jagatsinghpur, arising out of Kujang P.S. Case No.178 of 2022, for offences under Sections 363/366/376(2)(n)/34 of IPC read with Section 6 of POCSO Act.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional District Judge-cumSpecial Court under POCSO Act, Jagatsinghpur, by order dated 20.08.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the order of rejection.

The 164 Cr.P.C. statement of the victim is taken on record.

Considering the tenor thereof and keeping in view that the charge-sheet has already been filed in the meanwhile, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter. 8.
Accordingly, the BLAPL stands disposed of.
