Heard Mr. A. Sikdar, learned counsel for the Petitioner and Mr. S.N. Nayak, learned Additional Standing Counsel for the State. 3.

The Petitioner has filed this writ petition seeking direction to opposite party no.3 to provide the certified copy of the order passed on 12.08.2022 in Encroachment Case No. 117/22-23 and not to evict him from the unauthorized encroachment of the government land.

Mr. A. Sikdar, learned counsel for the Petitioner contended that after the order dated 12.08.2022 in Encroachment Case No. 117/22-23 was passed by the opposite party no.3, even though the petitioner applied for the certified copy, the same has not been provided. Unless the order is provided, petitioner will be able to prefer the appeal. The petitioner has applied for the certified copy, counter foil of which is placed on record under Annexure-3. 5.

Mr. S.N. Nayak, learned Additional Standing Counsel for the State contended that on the basis of the copy application filed by the petitioner, the certified copy of the order will be provided within ten days.

Having heard learned counsel for the parties and after going through the record, since statement is made by the Additional Standing Counsel for the State that certified copy will be provided within seven days hence, this writ petition stands disposed of on such submission. The moment the certified copy is received, the petitioner will have the liberty to avail the remedy available under law.
