This matter is taken up through hybrid arrangement Order No.
(virtual/physical mode).

The Petitioner having been implicated in connection with Khojuripada P.S. Case No.95 of 2015 corresponding to G.R. Case No.104(A) of 2015 on the file of learned Additional Sessions Judge-cum-Special Judge at Phulbani of Kandhamala for alleged commission of offence under Sections 363/376(2)(i)(n)/323/506, I.P.C. read with section 6 of the POCSO Act has filed this application under section 438 of Cr.P.C. for reconsideration of the prayer for grant of bail in the event of his arrest in the said case.

Heard learned counsel for the Petitioner and learned counsel for the State.

Considering the submissions made and on going through the materials as placed as also taking into account the
// 2 // surrounding circumstances; while being not inclined to reconsider the prayer for grant of anticipatory bail to the Petitioner; this application stands disposed of with an observation that in the event the Petitioner surrenders before the court in seisin of the aforesaid case within four weeks hence and moves for his release on bail, the same shall be considered on its own merit, without being prejudiced by this order and disposed of early in accordance with law. The case record be made available at the cost of the Petitioner. 5.
The ABLAPL is accordingly disposed of.
