This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the, learned Addl. Standing Counsel for the State. Perused the records.

This is an application under Section 438, Cr.P.C. filed by the for anticipatory bail.

Learned counsel for the Petitioner submits that the dispute is a civil dispute between the Petitioner and the land owners. It is further submitted by the learned counsel for the Petitioner that in order to put the Petitioner behind bar lodged the present F.I.R. against the Petitioner.

Considering the nature of allegations made, gravity of the offence and the fact of the case, I am not inclined to grant anticipatory bail to the Petitioner. However, it is directed that in the event the Petitioner surrenders before the learned S.D.J.M.,

// 2 // Bhubaneswar in C.T.Case No.2992 of 2022 arising out of Sahidnagar P.S.Case no.219 of 2022 within a period of three weeks from today and moves for bail, he shall be released on bail on such terms and conditions as the learned magistrate may deem just and proper. Further, the Petitioner shall furnish an undertaking that he will abide by the orders passed by the competent court of law in respect of the disputed property.
