This matter is taken up through Hybrid Mode.

Order No 2.

Heard learned counsel for Petitioner and learned counsel for the State-Opposite Parties.

The present Writ Petition has been filed with the following prayer:- "(i) The Opp. Parties shall not be directed to give appointment to the petitioner as Junior Assistant/ Junior Clerk under the OCS (RA) Rules, 1990 but not under the OCS (RA) Rules, 2020.

(ii) The impugned letter NO.480/E, dtd.15.02.2021 under Annexure-5 instructing the Petitioner to submit applicant for appointment against Group-D post shall not be quashed.

(iii) The non-consideration of the case of the petitioner from the year 2009 to till date shall not be held as illegal, arbitrary and contrary to law and the Opp. Parties shall not be held responsible for such delay in consideration of the applicant of the petitioner".

Learned counsel for the Petitioner submits that through highlighting his grievances, the Petitioner has filed a representation at Annexure-6 to the Writ Petition, before

// 2 // the opposite party No.3 but till date nothing has been done in the matter. In such background, he prays that a direction be issued to opposite party No.3 to take a decision on the above noted petition within a specific time period. 5.

Considering the submissions made and without expressing any opinion on the merits of the case, this Court directs opposite party No.3 to take a decision on the above noted petition in accordance with law within a period of three months from the date of production of certified copy of this order and communicate the result of such exercise to the petitioner.

6. With the aforesaid observation and direction, the Writ Petition is disposed of.
