This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the Petitioners, learned Addl. Standing Counsel for the State. Perused the records. 3.

This is an application under Section 438, Cr.P.C. filed by the Petitioners for anticipatory bail.

The Petitioners are seeking pre-arrest bail in connection with C.T.Case No.191 of 2022 arising out of Sarangada P.S.Case No.45 of 2022 pending in the Court of the learned S.D.J.M., Baliguda for commission of offences punishable under Sections 147, 148, 341, 294, 332, 333, 307, 353, 354, 506, 186/149 of the Indian Penal Code and Section 7 of Criminal Law (Amendment) Act 1932 and Section 3 of the Prevention of Damage to Public Property Act, 1984.

Considering the nature of the allegation, gravity of the offence and the facts of the case, although I am not inclined to grant anticipatory bail to the Petitioners, however it is observed that, in the event the Petitioners surrender before the learned court in seisin over the matter within a period of three weeks from today, the Petitioners shall be released on bail on such terms and conditions as the learned Magistrate may deem just and proper after due verification of injury report against the Petitioners.

The ABLAPL is disposed of accordingly.
