Heard Mr. G.K. Mohanty, learned counsel for the Petitioner and Ms. S. Mishra, learned Additional Standing Counsel. 2.

This is an application under Section 439 Cr.P.C. for grant of bail to the Petitioner Basudev Baghel @ Basu @ Harijan in connection with Umerkote P.S. Case No.198 of 2018 corresponding to C.T. Case No.12 of 2019 pending in the court of learned Additional Sessions Judge, Umerkote for alleged commission of offence under Sections 120-B/364/302/201/34 of the Indian Penal Code. 3.

It is submitted on behalf of the Petitioner that he is inside custody since 31st October, 2018 and till date charge has not been framed. It is further submitted that no eye-witness is there and the proposed circumstances are very weak against the Petitioner. 4.

Upon hearing Ms. Mishra, learned Additional Standing Counsel for State and considering the surrounding circumstances as well as the nature of materials collected in course of investigation, it is directed to

release the present Petitioner on bail in the aforesaid case on such terms and conditions to be fixed by the learned court in seisin over the matter including the condition that, the Petitioner shall attend the trial court on each date fixed and that, he shall not dissuade any witness directly or indirectly by way of inducement, threat or promise acquainted with the facts of the case from disclosing such facts before the Court or tamper with the evidence.

The BLAPL is accordingly disposed of.
