This matter is taken up through Hybrid mode.

Pursuant to direction of this Court, Mr. Biswaraj Panda, DFO, Baliguda is present in person and files an affidavit along with some documents. Annexure-C to the affidavit shows that felling permission has been granted only on 3rd December, 2022.

Mr. Dash, learned AGA, however, referring to para-4 of the affidavit submits that due to non-availability of details of properties in major Settlement, the delay in issuance of Annexure-C has occurred. This Court does not appreciate the delay in complying with the direction of this Court. 4.

Since felling permission has already been granted under Annexure-C to the affidavit, the Petitioner is at liberty to fell the trees as permitted and submit details of the same to the DFO, Baliguda. On furnishing such report, TT permit is expected to be issued in favour of the Petitioner within ten days therefrom in

// 2 // compliance of Rule 7(8) (j) of the Odisha Timber and other Forest Produce Transit Rules, 1980 (for short, 'the Rules'). The DFO is expected to comply with the direction of this Court at once after the Petitioner submits details as per Rule 7(8) (h) of the Rules.

With the aforesaid observation, the contempt proceeding is dropped.
