This matter is taken up through hybrid mode.

Heard learned counsel for the Petitioner and learned counsel for the State.

The Petitioner is an accused in C.T. Case No.200 of 2015 pending in the file of learned A.D.J.-cum-Special Court under POCSO Act, Balasore, arising out of Singla P.S. Case No.08 of 2015, offence under Sections 366/366(A)/376/34 IPC and Section 6 of the POCSO Act.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned ADJ-cum-Special Court under POCSO Act, Balasore by order dated 18.08.2022 in the aforementioned case, the present BLAPL has been filed. 5.
Perused the order of rejection and the statement of the victim recorded under Section 164 Cr.P.C.

Considering the same and keeping in view the age of the Petitioner and he being in custody since 4.5.2022 and filing of the charge sheet, this Court directs the Petitioner to be released on bail on such terms to be fixed by the learned court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
