This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

The present Interlocutory Application has been filed by the Petitioners seeking modification of order dated 22.09.2022. 3.

Learned counsel for the Petitioners submits that earlier the Injury Report was not there. When the Petitioner surrendered injury report was submitted stating that the injuries are grievous in nature. Learned counsel for the Petitioners further submits that the injured after receiving initial treatment he was hale and hearty. He also submits that the Petitioners do not have any criminal antecedents. 4.

Considering such submission the order dated 22.09.2022 stands modified to the extent that the direction pertaining to verification of Injury Report shall stand deleted. Further release of the Petitioners shall also be subject to verification of similar criminal antecedents. In the event it is found that the Petitioners have any

// 2 // similar nature of criminal antecedents this order shall not be given effect to. Further the following conditions be added. (i) The Petitioners shall cooperate with the investigation and appear before the I.O. as and when required; (ii) They shall not threaten, influence, terrorise or harass the informant and her family members in any manner whatsoever while on bail;

(iii) They shall not indulge in similar nature of criminal offence while on bail.

Violation of any of the conditions shall entail cancellation of bail of the Petitioners.

In view of the above, four weeks' further time from today is granted to the Petitioners to surrender as per order dated 22.09.2022, but subject to depositing cost of Rs.500/- (Rupees five hundred) by the Petitioners in the Advocates' Welfare Fund of the Orissa High Court within 15 days from today and furnishing money receipt thereof in proof of the said deposit.

It is made clear that, if cost is not paid within the aforesaid stipulated time, then the extension period to surrender shall stand automatically revoked.

The I.A. is accordingly disposed of.
