Heard Mr. N.K. Sahu, learned counsel for the petitioners and Mr. D.P. Dhalasamanta, learned counsel for opposite party no.1.

The petitioners have filed this writ petition challenging the order dated 18.09.2019 passed by the Central Administrative Tribunal, Cuttack Bench, Cuttack in R.A. No.260/2 of 2018 under Annexure-6.

Mr. N.K. Sahu, learned counsel for the petitioner contended that O.A. No.1019 of 2014, which was disposed of by the tribunal vide order dated 12.12.2017, subsequently, vide order dated 18.09.2019 passed by the tribunal in Review Application No. 260/2 of 2018, the said order has been recalled and the O.A. has been placed for final disposal. It is contended that the tribunal could not have reviewed its own order and therefore, the order so passed is without jurisdiction.

Mr. D.P. Dhalasamanta, learned counsel for opposite party no.1 contended that as per provisions contained in Section22(3)(f) of the Administrative Tribunals Act, the power is vested
with the tribunal to review its own order. Therefore, the contentions raised by learned counsel for the petitioners, so far as review of its own order by the tribunal, cannot sustain in the eye of law.

Considering the contentions raised by learned counsel for the parties and after going through the records, it appears that the order dated 12.12.2017 passed in O.A. No.1019 of 2014 has been recalled vide order dated 18.09.2019 passed by the tribunal in R.A. No.260/2 of 2018 and accordingly O.A. No.1019 of 2014 is pending for final disposal. Therefore, this court is not inclined to entertain the order dated 18.09.2019 passed by the tribunal in R.A. No.260/2 of 2018. However, the petitioners are permitted to participate in the proceeding in O.A. No.1019 of 2014 before the tribunal.

With the above observation, the writ petition stands disposed of.
